What this Agreement Covers

This Agreement governs your use of this Website ("Web Site" or "Site") and our service (the "Service"). The Service permits customers to purchase stock products, as well as custom signs, garments and other custom graphics merchandise. You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.

Intellectual Property Rights of Ours and Third Parties

We are committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on our Site (collectively the "Contents") are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by us. Some material used in the site  is for illustration purposes only and may not have been produced by Hamilton sign..

We are the owner of our own trademark; other trademarks made available through this Site, including logos, slogans, color schemes and design trademarks, are licensed for use by us from Institutions and other third parties (the "Licensed Marks"). By using this Site, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use and access of the Licensed Marks by the third parties. We will notify you of such terms if your usage is in violation of such terms.

Generally, products created using images available on the site should not be resold commercially. In the event that you wish to resell such products, you agree to contact us and verify the legality of reselling such products prior to doing so. Designs created using the text tools and images available through the site are in no way the exclusive property of the customers who assemble such designs. We retains the right to display such designs or offer them (or variations of such designs) to other customers.

Additionally, we have the sole discretion to reject any order that it considers libelous, defamatory, obscene, profane (according to standards established by the FCC), portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, disability or national origin, containing explicit sexual content or is otherwise inappropriate for our production.

You agree to not use our Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party.

Privacy Policy

We recognizes that you have a right to privacy, and we will not give or sell anyone specific information about you or any orders you have placed through our Site or Service except that: (i) we may share information about you or an order that you have placed with a relevant Institution in order to allow such Institution to review the use of the Licensed Marks as necessary; (ii) we may provide information about you and your order to its subcontractors; and (iii) we may share information about you with its marketing partners and affiliates for purposes of marketing. We may employ third party cookies which are used to target customers for advertising purposes. We collect information (including email addresses) that allows us, among other things, to: process and fill your order; contact you regarding the processing of your order; share your design with those whom you request; improve our website and service; and send informative and promotional emails that may be of interest to you. While this information may be used by us for marketing purposes, it is never shared or sold to other organizations for commercial purposes.

Limit of Our Responsibility

We will be responsible for acting only on those instructions sent us that actually are received and do not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of any orders you send. We are not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. We are not responsible should you give incorrect instructions or if your credit-card payment is not processed by your credit-card company.

The information and materials contained in this Site, including text, graphics, links or other items, are provided "as is", "as available". We do not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials.

In no event will we be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if we, or representatives thereof, are advised of the possibility of such damages, losses or expenses.

Intellectual Property Claims

We respects the intellectual property rights of others. We have a policy of removing user submissions that violate copyright, trademark, or other intellectual property laws, suspending or blocking access to the design-saving or other features of our site to any user who uses our site in violation of any such law, and/or terminating in appropriate circumstances the account (if any) of any user who uses our site in violation of any such law. If you believe your copyright, trademark, or other intellectual property right is being infringed by a user of our Site, please provide written notice to us.

In order for us to respond to your notice, it must: (i) contain your physical or electronic signature; (ii) identify the copyrighted work, trademark, or other intellectual property alleged to have been infringed; (iii) identify the allegedly infringing material in a sufficiently precise manner to allow us to locate that material; (iv) contain adequate information by which we can contact you (including postal address, telephone number, and e-mail address); (v) contain a statement that you have a good faith belief that use of the copyrighted material, trademark, or other intellectual property is not authorized by the owner, the owner's agent, or the law; (vi) contain a statement that the information in the written notice is accurate; and (vii) contain a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright, trademark, or other intellectual property right owner.


You agree to defend, indemnify and hold us or our affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or relating to your use of our Site and the Service, your violation of this Agreement, or your violation of any rights of another.

Governing Law

This Agreement shall be governed by the laws of the State in which our offices are located and will be governed by the law of our State, and where applicable, by federal law.

Privacy Policy

Hamilton LLC (“Company”) has adopted this Privacy Policy for its website (the “Site”).  The Policy describes situations in which information about users of the Site is collected, the purposes and use of that information, and choices you can make about information that pertains to you.  In this Policy, Company is referred to as “we” or “our.”  Users of the Site are referred to as “you.” 

  1. What We Do. We use our website to publish information about our products and services and to enable users to purchase certain products online.  We try to make it easy to use the Site and to deliver relevant information to you and other users.  In order to accomplish these goals, we need to collect information from or about users of the Site. 

  2. Types of Information Collected.  There are three general types of information that may be collected as a consequence of your use of the Site.  The most common is what we describe as “anonymous information.”  It is anonymous in the sense that it ties to an IP address, i.e. the machine used to generate the visit to the Site, but provides no information that is specific to the user of that machine.  The second is personally identifiable information (“PII”).  PII includes your name, address, e-mail address, phone number, or other information that is specific to you.  Generally, any PII we have about you would have to have been furnished by you.  Finally, we may obtain credit card information if you purchase products from us.  We handle different types of user information in different ways.  The type of information being collected impacts on whether or how much third party access is permitted.

  3. Anonymous Information We Collect to Provide Better User Experience.  In order to make user visits to our Site more productive and enjoyable, we may use “cookies” to track those visits.  A cookie collects anonymous information.  Using cookies allows us to know if users of a particular computer have been on the Site before.  That information, in turn, allows us to do things like display to you the searches you  undertook on recent visits to the Site.   

Cookies are downloaded onto your computer from our servers.  They cannot be opened or run by us on your computer and they cannot infect your computer with viruses.  You can disable cookies or otherwise manage them through tools provided with your browser software or with commercially available software packages.  If you turn off cookies, though, some features of the Site will not work as well or at all. Furthermore, if you simply remove cookies, you should be aware that another cookie will be downloaded on your next visit to the Site.  It is a process that happens automatically.

We or our vendors may also collect anonymous Site visit information in order to measure online marketing activity, to determine how the Site is working, to evaluate the content on the Site about which users are interested, and to otherwise try to make the Site meet user needs. Generally information captured for these purposes is reviewed and utilized in an aggregated fashion.  That is, we focus more on number or frequency of uses than on any particular visit. 

  1. Personally Identifiable Information We Collect on the Site.  We collect PII on the Site when you purchase products from us.  Our primary purpose for collecting the information is to enable prompt and accurate processing of your order.  We may also use PII to include you in email, website or direct mail announcements that contain information perceived to be of relevance to you.  You can opt out of this use. 

If you are an existing customer, we may have collected your PII through other means, including face-to-face or telephone contacts. This Private Policy relates only to information obtained as a consequence of your use of the Site, Except as described below, we will not sell, rent, or share any of your PII to or with third parties unless you have expressly consented to that use If we were to sell our business, the PII we have compiled would likely be transferred as part of that transaction, to the extent that PII was collected from use of the Site, though, the buyer would be subject to the same limitations on use of PII that are described in this Privacy Policy.

  1. Credit Card Transactions.  When you purchase services from us online through use of a credit card, we collect information that is of a more sensitive nature.  That credit card information is used only to process orders placed with us.  We utilize secure server software (SSL) to encrypt all account and personal information you input in connection with processing of an order.  We also segregate customer credit card data to protect it from unauthorized access.

  2. Data Security.  We develop, implement and periodically review procedures that are intended to protect personally identifiable information and any sensitive financial information stored by us. 

  3. Social Media Accounts.  We may collect information about you through social media accounts affiliated with us or the Site.  Unless you specifically choose to allow that information to be used in other ways (like e-mail newsletters or contests), we will only uses the information accessible as a consequence of contact by you through your social media account to contact you through the same social media channel where the original connection was made.

  4. Information About Children. The services we offer on the Site are not developed for, nor directed at children.  We do not employ or offer targeting toward children under the age of 18.  If you believe that your child has provided us with personal information and would like to have that information removed, you can contact us in the manner described in the “Contacts” section of this Privacy Policy.

  5. Privacy Choices.  If you wish to know whether we have collected personally identifiable information about you online, you can direct your inquiry to 651-247-8224.  We will use good faith efforts to respond within a reasonable time to your inquiry.  Similarly, we will use good faith efforts to respond within a reasonable time to any requests to you may make to update or change any PII which has been collected on or through our Site about you.

If you do not want us to use PII obtained on or through the Site to include you in e-mail, direct mail, or website announcements, you can opt out of that use of your PII.  That opting out can be accomplished by contacting us at 651-247-8224.

We will not disclose your PII to third parties for marketing purposes (other than a transfer of all records and information in connection with sale of our company) without your express consent (opt in).  Finally, if there are legally-required opt in or opt out choices that apply to us and are different from what is in this Policy, we intend to comply with those legal requirements.  Please let us know if you believe that information about you needs to be handled differently from what happens under our current practice.
